Offer, Acceptance, Contract

The the buyer’s order constitutes a commitment to buy from the seller and it is a contract of sale.

In case the seller determines that during the sales process the ordered product is no longer available then the the buyer will be promply be informed by e-mail.

The seller will communicate acceptance of the the buyer order via e-mail.(Order Confirmation) In this e-mail the details of the order and payment are included . The Order Confirmation is an acceptance of the purchase offer and constitutes a contract of sale.

Price, Payment Terms, Payment Date

The VAT will not be indicated separately on the invoice of goods exported outside Switzerland – it will be automtically be added to all orders placed from within Switzerland

The payment is to be made in advance.

The shipment of the ordered watches will take place after payment in full has been received.

The the buyer is obliged to pay the agreed price, or to make specific written agreements as to when and how the payment will be made. In the event of failure to do so, the seller has the right to cancel the order and place the product for sale again.

Right of withdrawal for the seller in case of untimely payment by the the buyer

If the the buyer fails to fulfill his payment obligations, then the seller can withdraw from the contract of sale without any specific deadline.

The withdrawal from the contract of sale by the seller is communicated in writing by e-mail.

Delivery, Shipping Costs, Transfer of Risk

The seller ships the purchased goods within two working days after full payment has been received to the address provided by the the buyer.

Special shipping arrangements can be made on request. We make every effort to meet delivery dates.

In the event of delivery delays caused by circumstances beyond our control which were not known to us at the time of receipt of your order, the delivery will be delayed accordingly.

We will give you notice of any such delays as quickly as possible.

The shipping costs are paid by the buyer.

At the buyer`s choice the purchased goods can also be collected at our company office during opening hours at a previously sheduled appointment.

The shipment is always fully insured, prepared and packaged properly, with care and it will be sent with a tracking number

Damage during Transport

Any damage incurred during transport should be reported immediately to the seller by email, the buyer is required to accurately describe in writing the damage or defect within 3 days after receipt of the goods.

Right of Withdrawal, Return Charges

The buyer is entitled to a right of withdrawal from his / her purchase.

Power of Revocation

The the buyer can revoke the sales agreement within 7 days in writing (e.g., by letter or e-mail) without giving any reasons, The term period begins on the day when the goods are received which will count as “day 1 of 7”

Legal consequences of revocation

In the case of an effective cancellation of the sales contract, the product must be returned in the condition in which it has been received;

if the merchandise is returned damaged or it has suffered deterioration as a result of unproper handling, un-authorized repair, or handling of the merchandise that went beyond checking its features and functions. (like opening and damaging the watch case-back) the cost of the necessary repair – or the determiation of the product`s diminished value – will be agreed in writing and it will be deducted from the amount refunded

“Checking features and functions” consists in testing and trying out our watches` functionality as it is generally done in the shop

The the buyer will pay for the return shipping

the product should be shipped back to the seller within three days from when the notice of order cancellation has been sent, and the merchandise whould be safely packaged and sent with a tracking number

The merchandise may only be shipped after consulting with the seller

End of the Power of Revocation

Exclusion of Revocation: The power of revocation does not apply in the case of goods that were made to specific buyer`s order, or goods that are clearly tailored to the personal requirements of the the buyer. (commonly, these could be watches that have a special presentations engraved)

Warranty, Liability, Damages

All of the merchandise will be delivered with specific guarantee terms

Excluded from the warranty for defects are the accuracy to chronometer grade performances (-5 / + 6 secs/ day), waterproof / water resistance, wear of the wristband and general wear and tear, scratches on the wristband or casing of pre-owned goods, unless otherwise specified in the relevant product description (ie.: watches sold as New”)

The seller is not liable for defects to the goods caused by improper handling of the buyer or any third parties, and this also applies for the general wear and tear of pre-owned watches.

The warranty for defects is null and void if the the buyer or a third party attempts to repair the watches themselves, unless specific written agreements have been made with the seller

The compensation for the violation of concrete contractual obligations is limited to the amount paid by the buyer.

Procurement Risk

The seller does not assume any procurement risk and retains the right to cancel the contract of sale if, through no fault of their own, the seller is unable to procure the agreed goods from its suppliers.

Data Protection

The seller respects the law concerning all data protection regulations. and only uses personal data for relevant purposes, for example for the contract of sale process. The collected data is in no way disclosed to outsiders, sold or passed on to third parties, unless specifically required for the contract of sale.

The seller collects, processes and uses the user`s personal data without further permission in order to complete the contract of sale and the invoicing/payment processes.

The seller may add the the buyer`s email address to the company`s distribution mail list.

Governing Law, Jurisdiction

Only Swiss law is applicable and the City of Lugano holds jurisdiction for all direct or indirect disputes arising from contractual issues.
